Terms & Conditions

These Terms and Conditions govern your use of the website at arkibpu.sbs and the services provided by Arkib Pusaka. Please read them carefully before using the website or engaging our services. By using the website or by signing the engagement scope note, you agree to these terms.

By submitting an enquiry through this website, by signing a Scope Note, or by otherwise engaging our services, you confirm that you are at least 18 years of age and have the capacity to enter into a binding agreement under Malaysian law. If you are engaging on behalf of a family group, you confirm that you are authorised to do so.

3. Service Description and Scope

Arkib Pusaka provides document inventory, archival digitisation, and family records research services. Our services are described in detail on the Solutions page of this website. Each engagement begins with a written Scope Note signed by both parties, which defines precisely what we will deliver.

We do not: advise on entitlements or ownership; represent anyone before any authority; value or hold property; or handle money on anyone's behalf. These limitations are stated in the Scope Note for every engagement.

Services are currently available in Kuala Lumpur, the Klang Valley, and — through courier arrangement — elsewhere in Malaysia.

5. Payment Terms

All prices are quoted in Malaysian Ringgit (RM) and are as published on the Solutions page at the time of engagement. Fixed prices for each service are:

Payment is invoiced in two stages: 50% upon acceptance of the Scope Note and 50% upon completion of the final handover. Payment is by bank transfer only. Invoices are payable within 14 days of issue.

For the Document Inventory Session, full payment is due within 7 days of the session date. We do not commence work until the first invoice is settled.

We treat all family information and documents as strictly confidential. We will not disclose any information about your engagement to any third party without your written consent, except where required by Malaysian law or by a court order.

All working copies of your documents held on our systems are deleted at handover. We issue a destruction certificate confirming deletion.

8. Intellectual Property

The content of this website, including text, layout, and design, is owned by Arkib Pusaka and may not be copied or reproduced without our written permission.

Documents you provide to us remain your property at all times. The inventories, indexes, and archive products we create for you under an engagement are delivered to you and become your property on final payment. We retain no copies after handover.

We provide document organisation and archival services only. We are not qualified to advise on legal matters, property valuation, tax, or financial planning. Nothing we produce — including inventories, timelines, or research summaries — constitutes legal, financial, or professional advice.

We make reasonable efforts to accurately record and describe documents but cannot warrant that every entry in an inventory is free from error. Families should verify important details with the relevant authorities or their own advisers.

10. Limitation of Liability

Our total liability to you for any claim arising from an engagement shall not exceed the fees paid for that engagement. We are not liable for any indirect, consequential, or special loss or damage arising from our services or from the information in documents we handle.

We will not be liable for delays or non-performance caused by circumstances outside our reasonable control, including but not limited to illness, flood, fire, or national emergency.

11. Governing Law and Dispute Resolution

These terms are governed by the laws of Malaysia. Any dispute arising from an engagement will first be addressed through direct negotiation between the parties. If a dispute cannot be resolved within 30 days of written notice, either party may refer the matter to the Kuala Lumpur Regional Centre for Arbitration (KLRCA) or commence proceedings in the courts of Malaysia, Kuala Lumpur jurisdiction.

We may update these Terms from time to time. The current version is always available on this page with the date it was last updated. Engagements in progress continue under the Terms in force at the time the Scope Note was signed.
